BOLI: Listening Sessions for House Bill 2866 - Relating to the Application of a Prevailing Rate of Wage to Off-site Bespoke Work

The Bureau of Labor and Industries (BOLI) is soliciting suggestions on the implementation of House Bill 2688 (2025).

BOLI is charged with enforcing this new law, which applies the prevailing rate of wage to certain off-site, bespoke work that is fabricated, preconstructed, assembled or constructed in accordance with specifications for a particular public works. Here is a link to the bill for more information:

The law will go into effect on July 1, 2026 and BOLI will promulgate administrative rules prior to that date.   In advance of the formal rulemaking process, BOLI will hold a series of listening sessions to gather the perspectives of interested parties.    These listening sessions are a great way to communicate any questions or suggestions you have related to this legislation.

BOLI will hold three listening sessions to gather feedback from interested parties, with each session focused on parties directly impacted by implementation of the law. These sessions will be held virtually via Microsoft Teams, and any member of the public may attend any of the three meetings.

If you are unable to attend one of these meetings, but wish to submit feedback you can submit your commentary online by clicking this link.  Please clearly describe your suggestion, concern or question.  If applicable or known, please provide any relevant support in the legislative record. For example, at least one interested party has suggested the following and provided the Governor’s signing letter as supportive documentation: Governor Kotek has indicated that House Bill 2688 should not apply to modular housing or mass timber products that are purchased from a manufacturer based on a common set of standards. These products should be classified as manufacturing that is exempted from the definition of public works.  

There will be future opportunities to provide feedback before rules are adopted. The last day to provide written feedback in response to this solicitation is Friday, November 7, 2025.
