Background
On August 22, FEMA has published an updated Draft EIS for public review and comment. The Draft EIS is noticed in the Federal Register and is available at FEMA’s NEPA Repository and the U.S. EPA’s EIS database.
FEMA is analyzing potential changes to how the NFIP is implemented in the Oregon plan area to comply with the Endangered Species Act (ESA) and the Magnuson-Stevens Fishery Conservation and Management Act (MSA).
Potential changes include:
- No net loss standards for development to avoid or mitigate adverse impacts to three floodplain functions.
- Additional vegetation requirements for non-water dependent use in the Riparian Buffer Zone.
- Changes to reporting requirements for NFIP participating communities.
No net loss requires that adverse impacts must be avoided or offset through mitigation so that there is no net change in the habitat function from the authorized existing condition (i.e., from when a floodplain permit application is submitted).
