When we refer to “SDAO”, “we”, “our”, etc., we are referring to the “Special Districts Association of Oregon”, the “PACE Liability Trust” and/ or the “Special Districts Insurance Services”. When we refer to “you”, “your”, “your organization”, and/ or our employees, board members, volunteers, contractors, sub-contractors, etc., we are referring to your organization and/or district, community college, educational service district, charter school, any similar organizational structure, and/ or your employees, board members, volunteers, contractors, sub-contractors, etc. The phrase “Terms of Use” and the phrase “Terms and Conditions” are used interchangeably, and should be considered synonymous, in this document.SDAO may modify this Web Site, and the terms and conditions governing its access and use, at any time. Any modification to the terms and/ or conditions will be summarized in these Terms and Conditions, so please check back when you use the Web Site. By continuing use of this Web Site after such changes are posted, you will be deemed to have accepted such changes.

Privacy Policy
SDAO’s Privacy Policy applies to use of this Site, and the Privacy Policy’s terms are made a part of these Terms of Use by this reference. Both this Terms of Use and the Privacy Policy were designed so they would not conflict with each other. SDAO invites you to view, use and download materials for your informational use, provided that you leave all the copyright notices or other proprietary notices intact. You may not use this site to engage in conduct which is defamatory, libelous, threatening or harassing or that infringes on a third party's intellectual property or other proprietary rights. In the event you engage in activity that is illegal, defamatory, libelous, threatening, or harassing, SDAO reserves the right to disclose any and all information to law enforcement authorities as SDAO, in their sole discretion, deems appropriate.

You agree that any information you provide through this site will be truthful and accurate.

SDAO reserves the right to require any person or entity to change their User ID or answers to security questions.

Submission of Information
By providing information or materials to this Web Site, you grant to SDAO an unrestricted and free-of-cost license to use, reproduce, display, publicly perform, and transmit such information and materials for any purpose, including without limitation, disclosing any such information and materials as necessary to satisfy any law, regulation, or governmental request.

You are prohibited from submitting or transmitting any information that contains, references or is in any way involved in content that:
  • Is unlawful, threatening, libelous, defamatory, obscene, racist, sexist, slanderous, offensive, or other material that would violate any law;
  • Contains nudity, would be considered pornographic, contains a link to any website that would not be considered appropriate for minors, contains a link to any website that would be considered adult in nature;
  • Is threatening or unlawfully harassing;
  • Which advertises or otherwise solicits funds or is a solicitation for goods, services;

  • Contains or solicits personal information from anyone under eighteen (18) years of age;
  • Includes a photograph of another person that you have posted without that person’s consent;
  • Is protected by copyright or that may infringe on intellectual property rights, including, but not limited to, any commercially released film or television footage or professionally produced images, unless used with the express permission of the copyright owner;
  • Violates any law or regulation (including without limitation those governing consumer protection, unfair competition, anti-discrimination or false advertising).
  • Otherwise violates or infringes the rights of others, including but not limited to intellectual property rights, copyrights, trademarks, service marks, trade secrets, or any other proprietary rights or rights of publicity or privacy;
  • Contains any personally identifiable information or protected health information;
  • Could give rise to any civil or criminal liability under the law.
Online Submissions
If you are an SDAO member or an SDAO member’s agent, and you submit information, such as schedule and/or coverage changes, online; please note that your submission does not commit SDAO to coverage. The web site is incapable of distinguishing between valid and invalid submissions. Therefore, each submission is reviewed before being accepted or denied by SDAO. SDAO does not provide notice in the event of an accepted submission. SDAO reserves the right to request additional information prior to reaching a decision or extending coverage.

Secured Areas/Passwords
Some and/or all portions of this site are restricted and require authorization for access. Unauthorized use of or access to these areas is prohibited. Actual or attempted unauthorized use of or access to such areas may result in criminal and/or civil prosecution. Attempts to access such areas without authorization may be viewed, monitored and recorded and any information obtained may be given to law enforcement organizations in connection with any investigation or prosecution of possible criminal activity.

SDAO provides each user who registers for online access to www.sdao.com a unique user ID. Each registrant assigns their own password. Keep your password private (just as your protect PINs you use for other transactions, such as ATM withdrawals). If you are an authorized user of any restricted area, you are responsible to maintain the security and confidentiality of your password. DO NOT SHARE YOUR PASSWORD WITH ANYONE. SDAO will never contact you with a request for your password. If you know or suspect that your password has been compromised, change your password immediately. If you suspect any unauthorized activity related to your account, you should contact SDAO. SDAO will not be responsible if you do not properly secure your password or if you choose to share your password with anyone else. In order to protect your personal information SDAO encourages you to change your password at least every 3 months.

Registered users may edit their SDAO account information at any time. SDAO staff may update your record based on information we have received in the form of written or electronic records or spoken words. After you have successfully registered for the SDAO site, your registration is reviewed and activated by SDAO personnel. An account activation confirmation is then e-mailed to you at the address submitted during registration. SDAO reserves the right to require any person or entity to change their User ID or answers to security questions.

E-mail
The SDAO computer network (which includes, but is not limited to, the technology and applications which support the e-mail functionality SDAO provides its officers, employees, independent contractor agents, and other authorized users), and email system, is the private property of SDAO and is intended only for purposes authorized by SDAO. No person or organization is authorized to, and is in fact prohibited from, any bulk e-mail transmissions sent to any e-mail addresses unless SDAO, through one of its officers, has, in writing, specifically requested or authorized the sending of such bulk e-mail. For purposes of these Terms of Use, the word "bulk" shall mean an e-mail message, or group of identical or similar e-mail messages, sent to more than five (5) different e-mail addresses in any 24-hour period.

SDAO Specifically Prohibits:
  • Any e-mail transmissions of the following types to be sent, or caused to be sent, over the Internet to more than 5 different @sdao.com e-mail addresses in any 24-hour period unless SDAO, through one of its officers, has authorized the sending of such e-mail:
        (1) Commercial advertising; 
        (2) Informational announcements; 
        (3) Political or religious tracts; or 
        (4) Solicitations for funds or donations
  • Any e-mail transmission to be sent, or caused to be sent, over the Internet to any @sdao.com e-mail addresses if the e-mail is intended to, or appears intended to, harass, embarrass, threaten, defame or impersonate any person, or if the e-mail is pornographic, offensive, indecent, discriminatory or offensive on the basis of sex, color, national origin, race, age, religion, sexual orientation or disability;
  • Any e-mail transmission to be sent, or caused to be sent, over the Internet to any @sdao.com e-mail address that makes use of a forged header or deceptive addressing, or which attempts in any manner to disguise the source of the e-mail;
  • The harvesting or collection of the e-mail addresses of SDAO agents and/or personal financial representatives from the sdao.com web site for the purpose of sending bulk e-mail to memberservices@sdao.com e-mail addresses.
SDAO reserves the right to take all legal and technical steps available, including pursuing civil remedies and criminal prosecution, to prevent bulk or other prohibited e-mail from entering, utilizing or remaining within the SDAO computer network.

Online quotes may not be available for all products, services or coverage selections. For additional information about products, services or coverage selections otherwise offered by SDAO, please contact your agent.

All quotes generated by this site are estimates based upon the information you provided and are not a contract, binder, or agreement to extend coverage. Any coverage descriptions provided on this site are general descriptions of available coverages and are not a statement of contract. To obtain coverage you must submit an application to SDAO. And due to the fact that this web site is operated on behalf of SDAO from their offices in Salem, Oregon and/or Tigard, Oregon, both of which are in the United States of America.

SDAO makes no representation that the content of this Web Site is appropriate or available for use in locations other than the State of Oregon, and access to this Web Site from territories where the content of this Web Site may be illegal is prohibited. SDAO Classified Ads Terms of Use


General
SDAO Classifieds is part of SDAO’s web service offerings to our members. Therefore, both SDAO’s primary “Terms of Use” and this “Classifieds - Terms of Use” are applicable to SDAO Classifieds. And this “Classifieds - Terms of Use” is meant to be considered an addition to SDAO’s primary “Terms of Use.” This “Classifieds - Terms of Use” was designed so it would not conflict with SDAO’s primary “Terms of Use.” But it should be noted that this “Classifieds - Terms of Use” will take precedence in situations where the two Terms of Use are in conflict.
 
Special Districts Association of Oregon (SDAO) provides classified advertising for its’ members, via its’ web site at www.sdao.com. By accessing or using SDAO’s Classifieds, you accept and agree to all the terms in this document (terms) as a legal contract between you and SDAO. If you do not accept and agree to all provisions of the terms, now or in the future, you may reject the terms by immediately terminating all access and use of SDAO’s Classifieds, in which case any continuing access or use of SDAO’s Classifieds is unauthorized. You are also required to comply with, and to ensure compliance with, all laws, ordinances and regulations applicable to your activities on SDAO’s Classifieds.
SDAO’s Classifieds are intended and designed for users 18 years of age and older, and access or use by anyone younger is not authorized.

Regulation
SDAO has the right, but not the obligation, to regulate any and all content posted to, stored on or transmitted by any party; to regulate conduct by any party; and to enforce these terms, for any reason and in any manner or by any means that SDAO deems necessary or appropriate. SDAO may, without notice, start, stop, or modify any regulation or enforcement measures at any time. Any action or inaction by SDAO to prevent, restrict, redress or regulate content, or to implement other enforcement measures against any content, conduct or potential violation is undertaken voluntarily and in good faith, and neither SDAO nor any SDAO Representative shall be liable to you or anyone else for any action or inaction.
 
SDAO also has the right in its sole discretion to limit, modify, interrupt, suspend or discontinue all or any portions of SDAO’s Classifieds, at any time and without notice. SDAO shall not be liable for any such limitations, modifications, interruptions, suspensions or discontinuance, or any purported losses, harm or damages arising from or related thereto.
On the other hand: SDAO does not control, is not responsible for and makes no representations or warranties with respect to your or any user’s conduct. You are solely responsible for your interaction with, or reliance on, any user or user conduct. You must perform any necessary, appropriate, prudent or judicious investigation, inquiry, research, and due diligence with respect to any user or user conduct. You are also responsible for your own conduct and activities. You agree to indemnify and hold SDAO and SDAO Representatives harmless from and against any third-party claim, cause of action, demand or damages related to or arising out of your own conduct or activities on, through or related to SDAO’s Classifieds.

Content
SDAO is not responsible for and makes no representations or warranties with respect to any user content. You are solely responsible for your access to, use of and/or reliance on any user content. You must conduct any necessary, appropriate, prudent or judicious investigation, inquiry, research, and due diligence with respect to any user content. You are also responsible for any content that you post or transmit.
Content that is specifically prohibited from SDAO’s Classifieds is: illegal content; content in facilitation of the creation, advertising, distribution, provision or receipt of illegal goods or services; offensive content (including but not limited to, defamatory, threatening, hateful or pornographic content); content that discloses another's personal, confidential or proprietary information; false or fraudulent content; and malicious content.
By posting any content to the SDAO Classifieds, you automatically grant and assign to SDAO, and you represent and warrant that you have the right to grant and assign to SDAO: A perpetual, irrevocable, unlimited, fully paid, fully sub-licensable (through multiple tiers), worldwide license to copy, perform, display, distribute, prepare derivative works from (including, without limitation, incorporating into other works) and otherwise use any content that you post. You also expressly grant and assign to SDAO: All rights and causes of action to prohibit and enforce against any unauthorized copying, performance, display, distribution, use or exploitation of, or creation of derivative works from, any content that you post (including but not limited to any unauthorized downloading, extraction, harvesting, collection or aggregation of content that you post).
You agree to indemnify and hold SDAO and any SDAO Representatives harmless from and against any third-party claim, cause of action, demand or damages related to or arising out of or in any way related to your use of SDAO’s Classifieds.
 
Postings
No user, including you, is allowed to circumvent any technological measure used by SDAO to restrict use of SDAO’s Classifieds, or to regulate the manner in which information may be transmitted to other users.
Unauthorized Access and Activities
  • The collection of users' personal information is not allowed for any purpose.
  • Any copying, aggregation, display, distribution, performance or derivative use of any content posted on SDAO’s Classifieds is prohibited.
  • Circumvention of any technological restriction or security measure, or any provision that restricts content, conduct, accounts or access. For purposes of this paragraph, you agree that cached copies of SDAO webpages on your computer or computer server constitute "copies" under the Copyright Act, 17 U.S.C. § 101. For purposes of this paragraph, you further agree that CAPTCHAs and telephone verification are "technological measures" that effectively control access to copyright-protected components and rights of SDAO pursuant to 17 U.S.C. § 1201.

Liability

Misc.
This constitutes the entire agreement between you and SDAO in relation to SDAO’s Classifieds, and supersedes any prior written or oral agreement that is directly related to your use of SDAO’s Classifieds. Other than SDAO Representatives, there are no beneficiaries to this agreement. Any and all claims, complaints or any other type of disputes, between you and SDAO and/or SDAO’s representatives, arising out of or related to SDAO’s Classifieds or content accessed through them, shall be governed by the laws of the State of Oregon. You and SDAO agree that any such claims, causes of action or disputes shall be brought exclusively in courts located within the county of Marion, state of Oregon, country of United States of America (U.S.A.), and you and SDAO agree to submit to the personal and exclusive jurisdiction of such courts. You further agree that, regardless of any statute or law to the contrary, you must file any such claim or cause of action within one year after such claim or cause of action arose or be forever barred. If any provision of this agreement or SDAO’s Classifieds is found by a court of competent jurisdiction to be unenforceable, the smallest possible section of this agreement or SDAO’s Classifieds shall be as if it were removed and all other provisions of this agreement and SDAO’s Classifieds shall remain in full force and effect.

CLASSIFIEDS – PRIVACY POLICY

SDAO Classifieds are part of SDAO’s family of web sites. Therefore, both SDAO’s primary “Privacy Policy” and this “Classifieds - Privacy Policy” are applicable to SDAO Classifieds. And this “Classifieds - Privacy Policy” is meant to be considered an addition to SDAO’s primary “Privacy Policy.” This “Classifieds - Privacy Policy” was designed so it would not conflict with SDAO’s Primary “Privacy Policy.” But it should be noted that this “Classifieds - Privacy Policy” will take precedence in situations where the two Privacy Policies are in conflict.
The point of SDAO’s Classifieds is to help members connect for mutually beneficial purposes. Therefore, information about both members is commonly shared via this site. SDAO protects your account information via password-protection. Keep your password safe.

We are not responsible for, nor have any control over, the privacy policies of those third party websites, and encourage all users to read the privacy policies of each and every website visited.
We collect and store your data as referenced in SDAO’s primary Privacy Policy. In addition, we may collect and store your data for purposes such as sending self-publishing and confirmation emails, authenticating user accounts, providing subscription email services, etc. We may share collected and stored data as referenced in SDAO’s primary Privacy Policy.
